Mediation Services

Many employment cases are driven by emotions - anger, pride, revenge and indignation to name just a few.  Many are driven by inflated expectations of case value or underestimations of exposure.  Others churn along because the parties have not fully considered the merits or applicable law, or because they have avoided settlement discussion for fear of appearing weak.  Settlement prospects diminish as the parties and their lawyers harden their positions and invest more time and money in the case.  Inertia sets in.  The parties increasingly lose control over their choices.  Power shifts to the judge and the judge's clerks, who - though with good intentions - can make profoundly wrong or underinformed decisions that shape the outcome.  The task of resolving the case is given over to a jury of eight people, each unpredictably random in his or her psychology, politics and life experience.
